ACKNOWLEDGMENT AND RELEASE I acknowledge that participating in a hot air balloon flight is a potentially hazardous activity. There are inherent risks in the activity, including severe injury or death. I understand that even though Rainbow Ryders, Inc. (hereafter called "Operator") has taken all reasonable precautions to provide an air-worthy balloon, equipment, and safety preparations for each flight, it is impossible for Operator to guarantee safety. I hereby release and waive my rights to make a claim for injuries or damages against Operator and its assignees, heirs, agents, employees and contractors, including but not limited to, Rainbow Ryders, Inc., Destination Southwest, LLC., Southwest Hospitotally, LLC., and Hyatt Corporation. 1. I acknowledge that I have voluntarily applied to participate in Hot Air Balloon Flight and associated activities to be conducted by Operator. 2. I am aware that a Hot Air Balloon flight is a potentially hazardous activity. Some of the risks include, but are not limited to, loss of or damage to personal property, arrest for trespassing or other violations of the law, injury or fatality due to capsize of basket or other vehicle, collision with obstacles on the ground or in the air, accident or illness in remote places without medical facilities, immersion in water, hypothermia, falling from the balloon while in the air or on the ground, fire or flame and temperature extremes or inclement weather. I am voluntarily participating in these activities with knowledge of the danger involved, and I hereby agree to accept and assume any and all risks of injury or death and verify this statement by signing below. 3. I understand that I share the responsibility for safety during the flight, and I accept this responsibility. I agree to comply with the instructions and directions of Operator and Operator's personnel before, during and after the flight. I acknowledge that I will comply with Operator's Safety Policy, as follows. Safety Policy: Passenger safety is Operator's first concern. Operator will make flight decisions based on a number of factors. Some of theses factors may include, but are not limited to: weather forecast; current conditions at launch preparation; the number and weight of passengers. All decisions concerning safety and whether to fly are at Operator's sole discretion. The passenger always has the discretion to decline his or her own flight. 4. To the best of my knowledge, I have no physical or psychological problems that would prohibit me from participating in a hot air balloon flight. I have carefully read this agreement and fully understand it contents.
